These Terms and Conditions ("Terms") govern your use of the Yakima Concrete & Masonry website at yakimamasonry.com (the "Site") and any services you request from Yakima Concrete & Masonry ("we," "us," or "our"). By accessing the Site or requesting services from us, you agree to these Terms. If you do not agree, please do not use the Site or request our services.
By using this Site or engaging Yakima Concrete & Masonry for any service, you confirm that you are at least 18 years old, that you have the legal authority to enter into a binding agreement, and that you accept these Terms in full. Yakima Concrete & Masonry is a licensed masonry contractor based in Yakima, WA. We provide masonry and concrete services including - but not limited to - foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, fireplace installation, stone and brick work, and related services throughout the Yakima Valley.
The Site provides general information about our services. It is not a binding proposal or guarantee of availability. All service engagements are subject to a signed written agreement or accepted written estimate between you and Yakima Concrete & Masonry.
All pricing is provided through a written estimate following an on-site assessment of your project. Estimates are based on conditions visible and accessible at the time of the assessment. If conditions are discovered during work that materially change the scope - for example, hidden damage uncovered during excavation or demolition - we will notify you before proceeding and provide a revised estimate for your approval.
Estimates are valid for 30 days from the date issued unless otherwise stated in writing. We reserve the right to withdraw or revise an estimate at any time before it is accepted.
Work is scheduled after an estimate is accepted and any required deposit is received. We will make reasonable efforts to meet agreed-upon start dates. Schedules may be affected by weather, material availability, or prior job delays. We will notify you promptly if a significant delay is anticipated.
If you need to cancel or postpone scheduled work, please notify us as soon as possible. Cancellations made less than 48 hours before a scheduled start date may result in a cancellation fee to cover mobilization costs already incurred. Any applicable cancellation fee will be stated in your written estimate or service agreement.
Payment terms are stated in your written estimate or service agreement. A deposit may be required before work begins. The remaining balance is due upon completion of the work unless otherwise agreed in writing.
If payment is not received when due, we reserve the right to suspend or discontinue work, and to apply interest to the outstanding balance at the maximum rate permitted by Washington State law. You are responsible for any reasonable costs we incur in collecting unpaid amounts, including attorney fees if permitted by law.
Any warranty on completed work will be stated in your written service agreement. Unless expressly stated in writing, our work is provided "as is" and to the best of our professional judgment at the time of completion.
Warranties, where provided, apply to defects in workmanship and materials supplied by Yakima Concrete & Masonry. They do not cover damage caused by acts of nature, misuse, alterations made by others, normal wear, soil movement beyond what was addressed in the original repair, or failure of adjacent structures not part of our scope of work.
The Site itself is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, Yakima Concrete & Masonry shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site or any services we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or related to a specific service engagement shall not exceed the amount you paid us for that specific engagement.
You agree to provide accurate and complete information when requesting an estimate or engaging our services. You are responsible for ensuring that we have reasonable access to the work area and that the site is safe for our crew to work in.
You are responsible for obtaining any approvals from homeowners associations, landlords, or co-owners that may be required before work begins. Yakima Concrete & Masonry is not responsible for delays or additional costs resulting from a failure to obtain required approvals.
If a dispute arises between you and Yakima Concrete & Masonry, we encourage you to contact us directly first. Most issues can be resolved quickly through a straightforward conversation.
If a dispute cannot be resolved informally, both parties agree to first attempt resolution through mediation before pursuing litigation. If mediation is unsuccessful, disputes shall be resolved in a court of competent jurisdiction in Yakima County, WA, in accordance with Section 10 below.
These Terms and any disputes arising from them or from any services provided byYakima Concrete & Masonry shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in Yakima County, Washington for any legal action arising under these Terms.
All content on the Site - including text, images, logos, and design - is the property of Yakima Concrete & Masonry or its content providers and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Site content without our express written permission.
We reserve the right to modify these Terms at any time. Changes take effect when posted to this page with an updated effective date. Your continued use of the Site or our services after changes are posted means you accept the revised Terms. We recommend checking this page periodically if you use the Site regularly.
